- 27 - (1) APPROVES, in accordance with the provisions of Article 9*t(a) of the Convention aforesaid, the following proposed amendment to the said Convention: "in Article 56 of the Convention the expression 'twelve members' shall be replaced by 'fifteen members'." (2) SPECIFIES, pursuant to the provisions of the said Article 9**(a) of the said Convention, eighty as the number of Contracting States upon whose ratification, the aforesaid amendment shall come into force; and (3) RESOLVES that the Secretary General of the International Civil Aviation Organization shall draw up a Protocol, in the English, French and. Spanish languages, each of which shall be of equal authenticity, embodying the amendment above-mentioned and the matters hereinafter appearing: (a) the Protocol shall be signed by the President of the Assembly and its Secretary General; (b) the Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation; (c) the instruments of ratification shall be deposited with the International Civil Aviation Organization; (d) the Protocol shall come into force in respect of the States that have ratified it on the date on which the eightieth instrument of ratification is deposited; (e) the Secretary General shall immediately notify all Contract- ing States of the date of deposit of each ratification of the Protocol; (f) the Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force; (g) with respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.
- 28 - Al8-3: Ratification of the Protocol amending Article $6 of the Convention WHEREAS the Assembly has decided to amend Article 56 of the Convention to provide for an increase in the size of the Air Navigation Commission; and WHEREAS the Assembly is of the opinion' that it is highly desirable that the aforesaid amendment should come into force before the new membership of the Commission is appointed in December 1971; THE ASSEMBLY: (1) RECOMMENDS to all Contracting States that they ratify the amendment to Article 56 as soon as possible, preferably before 1 December 1971 so as to enable the Council to elect the members of the expanded Commission before 1 January 1972; (2) DIRECTS the Secretary General to bring this resolution immediately to the attention of Contracting States, with the objective mentioned above. A18-U: Measures to be taken in pursuance of Resolutions 2555 and 270H of the United Nations General Assembly in relation to South Africa THE ASSEMBLY, HAVING CONSIDERED Working Paper AI8-WP/U7 EX/13 and Resolutions 2555 and 270U of the General Assembly of the United Nations regarding the Government of South Africa; BEARING IN MIND Resolution 2671 of the United Nations General Assembly which, among other things, calls upon States "to prohibit airlines and shipping lines registered in their countries from providing services to and from South Africa and to deny all facilities to air flights and shipping services to and from South Africa"; RECALLING its condemnation of the apartheid policies in South Africa in Resolution Al5-7; RECOGNIZING the need for maximum co-operation with the United Nations General Assembly in implementing its Resolutions; (1) RESOLVES that as long as the Government of South Africa continues to violate the United Nations General Assembly resolutions on apartheid and on the Declaration on the Granting of Independence to Colonial Countries and Peoples: (a) South Africa shall not be invited to attend any meetings convened by ICAO, except as provided in Articles U8(b), 53 and 57(b) of the Convention; Ct) South Africa shall not be provided with any ICAO documents or communications except (i) in cases where the Convention specifically requires that such documents or communications be provided and (ii) documents for meetings which South Africa is permitted to attend; (2) DECLARES that in case of conflict between the present Resolution and any other Assembly resolution, the present Resolution shall prevail.
- 29 - А18-5: Premises for ICAO Headquarters in Montreal APPRECIATIVE of the co-operation and assistance kindly extended to ICAO by the Government of Canada in connexion with the implementation of Resolution A16-12 relating to Headquarters premises; GRATEFUL for the generous financial support provided by that Government for the new ICAO Headquarters premises; THE ASSEMBLY RESOLVES to express its sincere appreciation and gratitude to the Government of Canada. Al8-6: Services of the Joint Inspection Unit THE ASSEMBLY, RECALLING its approval of the action’taken by the Council with respect to the recommendations in Resolutions 2150 (XXI) and 23б0 (XXII) of the General Assembly of the United Nations; NOTING the reports of the Joint Inspection Unit on its activities from January 1968 to June 1970; and NOTING the decision of the.Council to continue to use the services of the Joint Inspection Unit on an experimental basis until 31 December 1973; (1) APPROVES the decision of the Council; (2) REQUESTS-the Council to report to the next session of the Assembly any proposals by the Joint Inspection Unit for modifications of ICAO practice and procedures that are not within the power of the Council to make or that for other reasons it wishes to report to the Assembly; and (3) DECLARES that Resolution A16-15 is superseded by this Resolution.
- 30 - А18-7: Discharge by Contracting States of Financial Obligations to the Organization WHEREAS Article 62 of the Convention on International Civil Aviation provides that the Assembly may suspend the voting power in the Assembly and in the Council of any Contracting State that fails to discharge, within a reasonable period, its financial obligations to the Organization; and WHEREAS Resolution A16-56 contains the procedures to be followed and action to be takbn in the case of States in arrears; THE ASSEMBLY: (1) IMPRESSES upon al 1 Contracting States the necessity to pay their contributions in the year in which they fall due and as early in that year as their financial systems permit, in order to avoid the need for the Organization to draw on the Working Capital Fund to make good the shortfall; (2) RESOLVES that all Contracting States which are more than two years in arrears in the payment of their contributions should, in addi- tion to paying annually, in full, their current contributions: a) effect, by 31 December 1971, payment of part of their arrears by a contribution in the amount of no less than $2 000, such minimum amount to be increased proportionately in cases of States which are assessed at more than the minimum contribu- tion of the ICAO scale; b) conclude within six months of the date of the payment referred to in sub-paragraph a) above, if they have not already done so, an agrebment with the Organization for the settlriment of the balance of their arrears^ such agreement to provide for pay- merit of the balance of trie arrears over a period of rib more tlian teii years, which period may, at the discretion of the Council, Ьё extended, in special cases, to fifteen years or more; (3) FURTHER RESOLVES that should satisfactory arrangements not have been entered into or, having been entered into, not been met by the time of the convening of the 197^ session of the Assembly, that session should then consider whether it is appropriate to apply the provi- sions of Article 62 of the Convention; (Ю DECLARES that this Resolution supersedes Resolution A16-2.
- 31 - Д18-8: Technical Assistance WHEREAS the growth and improvement of civil aviation can make an important contribution to the economic development of developing countries; WHEREAS ICAO, as a participant in the United Nations Development Programme (UNDP), can materially assist these countries in advancing their civil aviation and at the same time promote the realization of the objectives of this Organization; and WHEREAS the Assembly in I968 adopted a consolidated Resolution, A16-6, dealing with the policies and procedures of technical assistance and has decided that this resolution should be replaced by the following: THE ASSEMBLY: A. Policy of ICAO ICAO Parti- cipation in Technical Assistance Programmes Implementa- tion of new policies Regional and Inter-regional Projects Administra- tive Costs (1) APPROVES the steps taken by the Council of ICAO to participate in the UNDP; recognizes and encourages the action taken by the Council in the field of technical assistance, which has been effectively provided with the limited funds available; requests the Council to continue to take such steps as may be necessary to ensure that the funds made available to the Organization from that source are used to achieve the maximum results; (2) REQUESTS the Secretary General to co-operate with the UNDP and the specialized agencies and organizations of the United Nations family in the implementation of the new policies established for the conduct of UNDP activities, and to adapt, as necessary, the Secretariat structure in the technical assistance field better to discharge the Organization's responsibilities in relation to the UNDP; (З) REQUESTS that high priority continue to be given to the process- ing of regional and inter-regional projects because of the great benefit such projects represent; (U) ENDORSES the view of the Council that the cost of Headquarters administration and operation of ICAO technical assistance acti- vities should continue to be met: for the administration of UNDP projects, by that Programme, for other forms of technical assistance undertaken by ICAO, as, for example, funds-in-trust, by the interested parties;
- 32 - Regional Training Centres Co-ordination with other Aid Programmes Co-ordination with other Agencies in the Field of Education and Training (5) CONCURS in the policy of establishing conveniently located training centres with aid requested by States from the UNDP and encourages Contracting States to regard these institu- tions as regional training centres which will provide ad- vanced aeronautical training to neighbouring States; (6) AFFIRMS that in order to promote co-ordination of the tech- nical assistance activities of ICAO with those of other civil aviation mutual aid pm gramma я , there should be, in so far as is practicable, a regular exchange of information on plans and progress reports between ICAO and other civil aviation mutual aid programmes; (?) CONCURS with Resolution 906 (XXXIV) of the Economic and Social Council on the subject of education and training and stresses the importance of this subject in the field of civil aviation and in the better preparation of students for such specialized training; Д18-8 (Cont'd) B. Action by States Priorities (8) URGES Contracting States to ensure that full consideration and Project is given to their needs for assistance in the field of civil Planning aviation when UNDP country programmes are formulated; (9) REQUESTS recipient States, when determining the priorities of their programmes, to concentrate any requests for assis- tance in civil aviation on the ground services to civil aviation, including the training of personnel concerned, and invites them to draw up long-range plans for that purpose, in particular for the organization of their civil aviation activities and the development of their civil aviation administrations, using for this purpose such forms of assistance as are available to them; (10) DRAWS THE ATTENTION of Contracting States requesting UNDP assistance to the advantages to be derived from individual programmes made up of well-defined projects based on the civil aviation development plans referred to in Clause (9) above, and urges States to co-operate with the Organization in defining as accurately as possible the task of each expert included in their individual programmes and to state clearly the scope of the assistance required when making requests to the UNDP or to some other mutual aid programme;
- 33 - Regional & Inter- RegionaT Projects Regional Training Centres Education and Training Funds-in- Trust Operational Assistance (OPAS) Counterparts and National Staff (11) DRAWS THE ATTENTION of Contracting States to the usefulness of the UNDP assistance provided through the regional and inter-regional projects executed by ICAO, and urges States to utilize further this type of assistance and to ensure that their national co-ordinating authorities give full support toithose projects when preparing their inter- country programmes, so as to meet the needs of their civil aviation services; (12) URGES States where Regional Training Centres are located, and also States in the area, to support them and to send to them students whose tuition will be paid for by the States themselves, in addition to those financed from UNDP funds; (13) INVITES States to call upon UNESCO, other specialized agencies or the UNDP for assistance in.the establishment of preliminary training schools at the national level or for the development of existing schools, stressing at the same time the importance of national and regional aero- nautical training centres as the most effective means of training qualified specialists in civil aviation; (14) COMMENDS the Funds-in-Trust scheme and views with satis- faction the initiative of States in establishing Funds-in- Trust programmes as a method of obtaining technical and operational assistance in the field of civil aviation, over and above that provided from the UNDP funds, by direct payment to ICAO of the money needed; and urges States to make greater use of this arrangement to expedite implemen-’ tation of Regional Plans; (15) DRAWS THE ATTENTION of Contracting States to the importance of and the benefits to be derived from the operational assistance experts under the UNDP and encourages those States needing such experts for their civil aviation activities to include them in their requests for assistance from the UNDP (Technical Assistance); (16) REMINDS States receiving UNDP assistance of their obligation to provide, as part of any project that re- quires the services of experts in an advisory or training capacity, suitably qualified counterpart personnel, from among their own personnel, to work with the ICAO experts, and to provide such opportunities and conditions of service as are necessary to attract the continued services of such staff; furthermore, reminds States of the need to provide suitable incentives, within the limits of their resources, to retain the services, in their respective fields, of all students after they have completed their training;

Experts' Recruitment (17) REQUESTS that Contracting States should, to the extent possible, of Experts co-operate with ICAO by encouraging experts in their service to apply for ICAO technical assistance work in the various branches of civil aviation and by facilitating their secondment for this purpose with the least possible delay; in referring candidates to the Organization, Contracting States should endeavour to ensure that they are fully qualified technically and suitable personally for technical assistance work; States providing ex- perts should themselves maintain rosters of suitable candidates, due consideration being also given to the possibility of employing recently retired experts; and urges Contracting States to consider the possibility of organizing their establishments in such a way as to be able to make available, at all times, a certain number of experts for technical assistance work; (18) REQUESTS the Secretary General, to the extent possible taking into account the element of time and the urgency of particular projects, to announce vacancies in technical assistance projects executed by the Organization to States in good time, so as to pennit States providing experts to submit candidates for consid- eration; such announcements should contain sufficient precise detail to enable the States to nominate personnal having the specific qualifications necessary to fill a vacancy. FURTHERMORE THE ASSEMBLY: DECLARES that Resolution A16-6 is superseded by this Resolution. A18-9: Speedy Adoption and Ratification of a Convention on Acts of Unlawful Interference with International Civil Aviation Other Than Acts of Unlawful Seizure of Aircraft WHEREAS the Legal Committee of the Organization has completed, pursuant to Resolution A17-20 of the Seventeenth (Extraordinary) Session of the Assembly, a draft international convention to deal with the problem of unlawful interference with civil aviation other than unlawful seizure of aircraft; and WHEREAS a diplomatic conference will convene on 8 September 1971 to consider that draft convention; THE ASSEMBLY: (1) CALLS UPON States invited to attend the diplomatic conference to make every reasonable effort at such conference to agree on a convention on the subject, after considering the draft convention prepared by the Legal Committee; and (2) CALLS UPON States invited to the diplomatic conference to give early consideration to the ratification of the convention adopted at the conference.
- 35 - Д18-10: Additional Technical Measures for the Protection of the Security of International'Civil Air. Transport WHEREAS the threat of acts of unlawful interference with international air transport continues to be a real and present danger; and WHEREAS the safety of the peoples of the world who benefit from inter- national air transport requires continued vigilance and positive deterrent, action by the Organization and its member governments ; THE ASSEMBLY: (1) REQUESTS the Council to, ensure, with respect to the technical aspects of air.transportation security, that: (a) the. subject of-air transportation security continues to be given adequate attention by the Secretary General, with a priority,commensurate with the current threat to the security of air transportation; (b)' in the. case of those meetings of components of the Organis- ation where the subject matter is appropriate, their a.genda includes, those items dealing with air transportation security which are pertinent to the subject of that meeting; (c) consideration is given to a special ICAO meeting on and when a need for it is this field; convening in the 1972-7U triennium air transportation security, if demonstrated by developments in (2) URGES Contracting States that have not already done so to implement as soon as possible the recommendations of the l?th Session of the Assembly, particularly those dealing with the establishment of local airport security committees and the exchange and dissemi- nation of information.
- 36 - Al8-11; ICAO Position at the International Conference on the Problems of the Human Environment (Stockholm, June 1972) WHEREAS an International Conference on the Problems of the Human Environ- ment under the aegis of the United Nations will convene in 1972; WHEREAS this Conference aims to encourage and to provide guidelines for action by Governments and International Organizations towards the harmonization of industrial and technological development with the preservation of a wholesome human environment; WHEREAS advancing technology has caused civil aviation to become a significant influence in the human environment; WHEREAS the preamble to the Convention on International Civil Aviation states that "the future development of international civil avia- tion can greatly help to create and preserve friendship and under- standing among the nations and peoples of the world..." and Article UU of that Convention states that ICAO should "develop the principles and techniques of international air navigation and ... foster the planning and development of international air transport so as to ... meet the needs of the peoples of the world for safe, regular, efficient and economical air transport"; WHEREAS many of the adverse environmental effects of civil aviation activity can be reduced by the application of technology and the appropriate use of airport planning and land use control mechanisms; and WHEREAS in fulfilling its role, ICAO strives to achieve a balance between the benefit accruing to the world community through civil aviation and the harm caused to the human environment in certain areas through the progressive advancement of civil aviation; THE ASSEMBLY RESOLVES that the United Nations Conference on the Problems of the Human Environment be informed that: (1) the Convention on International Civil Aviation places on ICAO the responsibility to guide the development of international civil aviation in such a manner as to benefit the peoples of the world; (2) in fulfilling this role ICAO is conscious of the adverse environ- mental impacts that may be related to aircraft activity and of its responsibility and that of its member States to achieve maximum compatibility between the safe and orderly development of civil aviation and the quality of the human environment; (3) in discharging its responsibility, ICAO is already assisting and will continue to assist States by all available means, in order that they may increasingly reap the benefits of the potential which civil aviation offers for improving living conditions. THE ASSEMBLY FURTHER RESOLVES to invite Contracting States to support, at the United Nations Conference on the Problems of the Human Environment, the position established in this Resolution.
- 37 - А18-12: Development of Standards, Recommended Practices and Procedures and/or Guidance Material relating to the Quality of the Human Environment WHEREAS the Airport Master Planning Manual published by ICAO in 1969 states that in long-range planning for airports, including the expansion of existing airports, planners should assess their proposed plan's potential impact on the airport's environment; WHEREAS the compatibility between the airport and its environment is one of the elements to be taken into account in long-term systems planning; WHEREAS the Report of the Second Meeting of the Sonic Boom Panel recognized that consideration will need to be given to pertinent economic, social and legal factors as well as to technical and operational aspects of the sonic boom problem; WHEREAS the SST Panel was established in 1967 for the purpose of facili- tating compliance with the technical and operational elements of Assembly Resolution A14-7, with particular emphasis on Clause (3) thereof, by ascertaining and studying the environments of super- sonic aircraft as well as the operational requirements, with a view to developing, where appropriate, proposals in the form of amendments to the ICAO technical Annexes and associated documents for those elements of the subject on which international agreement is necessary; WHEREAS the Council has adopted Annex 16 - Aircraft Noise, which comprises noise certification standards for future subsonic aircraft (except STOL) for the purpose of facilitating compliance with Assembly Resolution A16-3 and has notified Contracting States of this action: WHEREAS the Council has established a Committee on Aircraft Noise for the purpose of assisting in the development of further standards on aircraft noise, including those for aircraft not at present covered by Annex 16 - Aircraft Noise; and WHEREAS on.all these matters detailed criteria on which States can base their own regulations have not yet been forthcoming from ICAO; THE ASSEMBLY: (1) REQUESTS the Council, with the assistance and co-operation of other bodies of the Organization and of other international organizations to continue with vigour the work related to the development of Standards, Recommended Practices and Procedures and/or guidance material dealing with the quality of the human environment; (2) URGES Contracting States to adopt, where appropriate, the ICAO measures and procedures developed pursuant to Clause (1) of this Resolution.
- 38 - Al8-13: Consolidated Statement of Continuing Policies Related. Specifically to Air Navigation WHEREAS a statement of continuing policies related specifically to air navigation as they existed at the end of the 16th Session of the Assembly was adopted by the Assembly in Resolution A16-19, Appendices A to U inclusive; WHEREAS in Resolution A15-9 the Assembly resolved to adopt in each Session for which a Technical Commission is established a consolidated state- ment of continuing policies related specifically to air navigation up to date as at the end of that Session; WHEREAS in Resolution A16-20 the Council was directed to arrange for a recon- struction of Resolution A16-19, presenting policy material and other material separately in such form as the Council may find appropriate and embodying therein any new policies which, although intended by the Assembly, were not explicitly stated in Resolution A16-19; WHEREAS the Assembly has reviewed the reconstructed statement prepared by the Council in response to Resolution A16-20 and, in pursuance of Resolution A15-9, has amended it to reflect the relevant decisions taken during the 18th Session; and WHEREAS the statement of continuing policies in Resolution A16-19 is here- by rendered redundant; THE ASSEMBLY: (1) RESOLVES that: (a) the Appendices attached to this Resolution constitute the con- solidated statement of continuing air navigation policies and practices of the Organization as they exist at the close of the 18th Session of the Assembly; (b) the practices associated with the individual policies in the Appendices constitute guidance intended to facilitate and en- sure inpiementation of the respective policies; (2) DECLARES that this Resolution supersedes Resolution A16-19, with its Appendices A to U.
- 39 - А18-13 (Cont'd) APPENDIX A Air Navigation Meetings of World-wide Scope WHEREAS the holding of world-wide air navigation meetings is an important function of ICAO and entails substantial expenditures of effort and money by the Contracting States and the Organization; and .WHEREAS it is necessary to ensure that maximum benefit, is obtained from these meetings without imposing any undue burden upon the Contracting States or the Organization; THE ASSEMBLY RESOLVES that: (1) meetings, convened by the Council, in which all Contracting States may participate on an equal basis shall be the principal means of progressing problems of world-wide import, including the develop- ment of amendments to the Annexes and other basic documents in th~e air navigation field; (2) such meetings shall be convened only when justified by the number and importance of the problems to be dealt with and their maturity for constructive action; meetings convened on this basis may, how- ever, also be requested to conduct exploratory discussions on matters not mature for definite action; (3) the composition and organization of such meetings shall be arranged so that they are best suited to carry out the assigned task and to provide proper co-ordination among the technical specialties in- volved; and (U) unless necessitated by extraordinary circumstances, not more than two such meetings shall be convened in a calendar year, and success- ive meetings dealing extensively with the same technical specialty shall be separated by at least twelve months. ASSOCIATED PRACTICES 1. Before deciding to refer a matter to a world-wide meeting, the Council should consider whether correspondence with States may be an effective way of disposing of it or of facilitating subsequent action on it by a future meeting. 2. The agenda should be sufficiently explicit to define the task to be performed and to indicate the types of specialized expertise that will be needed at the meeting. In an agenda including more than one technical specialty the types of expertise called for should be kept to the minimum compatible with efficiency.

To facilitate the participation of all Contracting States, the Council should so plan the meeting programme as to keep to the minimum consistent with efficiency the demands upon the time of States' technical officials. h. The planned duration of a meeting should allow adequate time for completion of the agenda, study of the report as drafted in the working languages of the meeting and approval of the report. Following the meeting, the Secretariat should make any necessary minor editorial amendments and typographical corrections to the meeting report. 5. The approved agenda and the main supporting documents should be despatched, normally by air, not less than three months in advance of the convening date; other documentation should be despatched as soon as possible. ASSOCIATED PRACTICES 1. The Council should endeavour to hold RAN meetings at sites within the areas concerned and should encourage the.Contracting States within those areas to serve as host, either individually or jointly. 2. The documentation and, in particular, a draft statement of operational requirements and planning criteria should be de- spatched, normally by air, not less than three months in advance of the convening date. 3. The Council should ensure that adequate guidance is made available to RAN meetings on operational and technical matters relevant to their agenda. 4. Each participating Contracting State should inform itself, in advance of a meeting, on the plans of its air transport operators and its international general, aviation for future operations and, similarly, on the expected traffic by other aircraft on its registry and on the overall requirements of these various cate- gories of aviation for facilities and services. 5» The Council should foster the establishment for and by RAN meetings of any planning criteria which would aim to ensure that Regional Plans satisfy the operational requirements and are economically justified. 6. The Council should develop specific and detailed directives for consideration at RAW meetings of implementation matters.
- 42 - A18-13 (Cont'd) APPENDIX C Panels of the Air Navigation Commission (ANC) WHEREAS panels of the Air Navigation Commission have proved a valuable medium for advancing the solution of specialized technical problems; and WHEREAS it is necessary to ensure that maximum benefit is obtained from Air Navigation Commission panels without imposing any undue burden upon the Contracting States or the Organization; THE ASSEMBLY RESOLVES that: (1) panels of the Air Navigation Commission shall be established when it is necessary to advance the solution of specialized technical problems which cannot be solved adequately or expeditiously by’ the Air Navigation Commission through other established facilities; (2) the terms- of reference of panels shall be clear and concise and the panels shall be required to adhere to them; and (3) Contracting States shall be consulted before proposals- for amendments to SARPS and PANS stemming from recommendations of panels are submitted to the Council, unless considerations of exceptional urgency preclude such consultation. ASSOCIATED PRACTICES Reports should hp clearly presented as the advice of a group of experts to the Air Navigation Commission so that they cannot be construed as representing the views of Contracting States. , APPENDIX D Formulation of Standards and Recommended Practices (SARPS) and Procedures for Air Navigation Services (PANS) WHEREAS Article 37 of the Convention on International Civil Aviation requires the Organization to adopt and amend international standards and recommended practices and procedures and states the purpose of and the matters to be dealt with in that action, and Articles 38, 54, 57 and 90 contain additional relevant provisions; and WHEREAS the Assembly deems- it advisable to establish certain policies to be followed in complying with these provisions of the Convention; THE ASSEMBLY RESOLVES that: (1) the terms "Standard" and "Recommended Practice" shall have the following meanings:
- из - Al8-13 (Cont'd) APPENDIX D (Cont'd) a) Standard - any’ specification for physical characteristics, configur- ation, materiel, performance, personnel or procedure, the uniform application o'f which is recognized as necessary for the safety or regularity of international air navigation and to which Contracting States will conform in accordance with the Convention; in the event of impossibility of compliance, notification to the Council is com- pulsory under Article '38 of the Convention; b) Recommended Practice - any specification for physical character- istics, configuration, materiel, performance, personnel or pro- cedure, the uniform application of which ie recognized as desirable in the interest of safety, regularity or efficiency of interna- tional air navigation and to which Contracting States will endeavour to conform in accordance with the Convention; (2) SARPS and PANS shall be amended as necessary to reflect changing require- ments and techniques and thus, inter alia,to provide a sound basis for regional planning and the provision of facilities and services; (3) subject to the foregoing clause, a high degree of stability in SARPS shall be maintained to enable the Contracting States to maintain stability in their national regulations. To this end amendments shall be limited to those significant to safety, regularity and efficiency, and editorial amendments shall be made only if essential; (U) SARPS and PANS shall be drafted in clear, simple and concise language; (5) to the extent consistent with the requirements of safety and regularity, standards specifying the provision of facilities and services shall reflect a proper balance between the economic implications and the operational requirements for such facilities and services; (6) Contracting States shall be consulted on proposals for the amendment of SARPS and PANS before the Council acts on them, except when the Council may deem urgent action to be necessary; (7) the applicability dates of amendments to SARPS and PANS shall be so established as to allow the Contracting States sufficient time for their implementation; and
- Ml - A18-13 (Cont'd) APPENDIX D (Cont'd) (8) unless exceptional circumstances dictate otherwise, the applicability dates of amendments to SARPS and PANS shall be so established as not to require the Contracting States to amend their national regulations more often than once per year.. ASSOCIATED PRACTICES 1. The Council should ensure that provisions of SARPS and PANS are com- pletely co-ordinated. 2. Contracting States should comment fully and in detail on the proposals for amendment of SARPS and PANS or at least should express their agree- ment or disagreement on their substance. They should be allowed at least three months for this purpose. 3. Contracting States should be allowed a full three months for notifying disapproval of adopted SARPS amendments; in establishing a date for notifying disapproval the Council should take into account the time needed for transmission of the adopted amendments and for receipt of notifications from States. APPENDIX E Formulation of Regional Plans and Regional Supplementary Procedures WHEREAS the Council establishes regional plans setting forth the facilities, services and regional supplementary procedures to be provided or employed by the Contracting States pursuant to Article. 28 of the Convention; and WHEREAS the regional plans require amendment from time to time to reflect the changing needs of international civil aviation; THE ASSEMBLY RESOLVES that: (2) (1) regional plans shall be revised when it becomes apparent that they are no longer consistent with current and foreseen requirements of international civil aviation; and when the nature of a required change permits, the associated amend- ment. of the regional plan shall be undertaken by correspondence between the Organization and the Contracting States and inter- aatieaal argcaiaations concerned.

The Council should keep under review the effect of changing-re- quirements on the regional plans to ascertain in good time any need for their revision. 2. In assessing the urgency of any revision of the regional plans the Council should take into account the time needed by Contracting States to arrange for the provision of any necessary additional facilities and services. 3. The Council should establish guidance on the basic criteria on which far-sighted and realistic regional plans can be formulated. 4. The Council should ensure that implementation dates in regional plans involving the procurement of new. types of equipment are realistically related to the ready availability of suitable equip- ment. APPENDIX F Implementation of Standards and Recommended Practices (SARPS) and Procedures for Air Navi- gation Services (PANSY WHEREAS Article 37 of the Convention on International Civil Aviatiuu quires each Contracting State to collaborate in securing the high- est practicable degree of uniformity in regulations and practices in all matters in which such uniformity will facilitate and improve air navigation; WHEREAS in accordance with Article 38 of the Convention any Contracting State which finds it impractical to comply in all respects with any international standard or procedure and deems it necessary to adopt regulations or practices differing therefrom is obliged to give immediate notification to ICAO; and WHEREAS it is important that all available means of the Organization be employed in encouraging and assisting the Contracting States in overcoming their difficulties in implementation of SARPS and PANS; THE ASSEMBLY RESOLVES that: Contracting States shall be encouraged and assisted in the im- plementation of SARPS and PANS by all available means;'and (1)

APPENDIX F (Cont’d) the differences between the regulations and the practices of Contracting States and the SAPPS and PANS shall be monitored with the aim of encouraging the elimination of those differences that are important for the safety of international air navigation or are inconsistent with the objectives of the international standards. ASSOCIATED PRACTICES In encouraging and assisting Contracting States in the application of SAPPS and PANS the Council should make use of all existing means including the resources of the Headquarters, the ICAO re- gional offices and the United Nations Development Programme. Contracting States should continue, and where necessary should intensify,their efforts to apply at their operating installations practices and procedures that are in accordance with the current SARPS and PANS.' In this regard, the Contracting States should consider the practicability of modifying the internal processes by which they give effect to the provisions of SARPS and PANS, if such modifications would expedite or simplify the processes or make them more effective. The Council should urge Contracting States to report, in respect of their territories^’ all cases of non-compliance with, or in- complete implementation of, SARPS and PANS and at suitable inter- vals to provide reports on the progress made in implementing SARPS and PANS or on the reasons for non-implementation. In monitoring the differences from SARPS and PANS the Council should- request reports from Contracting States that have not fully reported or have never reported. The notification received should be promptly issued in supplements to the relevant Annexes and PANS documents. APPENDIX G Implementation of Regional Plans WHEREAS, iff accordance with Article 28 of the Convention Contracting States undertake, with' certain limitations, to provide air navigation fecili^ie'e and services necessary to facilitate international air navigation} WHEREAS the regional plans set forth the requirements for facilities and ЕОЙ71еей;'fter international cWH- aviation; and WHEREAS any serious snortcemings in tne implementation of regional plans Eay affect the safety, regularity and efficiency of international air operations and therefore should be eliminated as quickly as practicable;

ASSOCIATED PRACTICES 1. The Council should inform fully and promptly each Contracting State of the recommendations for the provision of air navigation facilities and services which are applicable to that State under the regional plans. 2. Contracting States should prepare and keep up to date suitable plans, including the requirements for personnel, for the orderly implementation of the parts of regional plans applicable to them. 3. The Council should arrange for the issue of periodic progress reports on the implementation of regional plans. 4. The users of air navigation facilities and services should report any shortcomings in the implementation of regional plans to the Contracting States responsible for taking remedial action. The latter should act oh such reports, but when no adequate remedial action is taken the users concerned should inform ICAO through the medium of an international organization where appropriate. APPENDIX H Aviation Training WHEREAS satisfactory provision and operation of ground facilities and services and implementation of SARPS and PANS are dependent upon a high standard of personnel training; WHEREAS difficulties are being experienced by Contracting States in these matters owing to a lack of adequately trained personnel; and WHEREAS special effort is required to foster a high standard of per- sonnel training and to assist Contracting States in meeting their training needs;
- U8 - A18-13 (Cont’d) APPENDIX H (Cont’d) THE ASSEMBLY RESOLVES that: (1) Contracting States shall be encouraged and assisted in the main- tenance of hi^i standards of training of aviation personnel and particularly those employed in the provision and operation of services and facilities for international air navigation. To this end, as a part of its regular work programme, the Organization shall carry out a continuing training progresses which is referred to as the ICAO Aviation Training Programs»*; and (2) the ICAO Aviation Training Programme* shall be governed by the following principles: a) aviation training is the responsibility of Contracting States; b) mutual assistance among Contracting States in the training of aviation personnel should be encouraged and facilitated, particularly in those matters where the lack of adequate trainfai^ may adversely affect the safety or regularity of international air navigation; and c) the Organization* should not participate in the operation of training facilities but should encourage and advise the Contracting States operating such facilities. ASSOCIATED PRACTICES 1. Through the development of specifications and guidance material, and by direct advice and consultation, the Council should assist Contracting States to': a) standardize, as far as practicable, the curricula, methods and content of training courses and establish adequate examination and licensing provisions; b) bring levels of accomplishment into line with international standards; and c) employ the criteria referred to in a) and b) above so as to bring about greater uniformity in operating practices and procedures. 2. Continuing attention should be given to the establishment by the Contracting States of specialized and advanced training courses when needed to provide the skills required to install, operate and maintain facilities and services. •Assistance provided by ICAO under the United Nations Development Programme and other programmes is governed by Resolutions A16-7 and A18-8.

The Council should encourage the Contracting States to: a) establish programmes for the on-the-job training, including familiarization with relevant operating conditions, for per- sonnel who, after completion of their basic training, require practical experience under actual operating conditions before being assigned to positions of responsibility in operational posts; in this regard States' attention should be invited to the possibility of drawing fully upon the resources of the various technical assistance and aid programmes; and b) arrange for periodic refresher training particularly when new equipment, procedures or techniques are introduced. The Council should request the Contracting States to provide, for dissemination to other States, information on the types of aero- nautical courses they sponsor or can arrange in which students are accepted from other States, including the address to which enquiries may be sent for additional details. Similarly, the Council should make available to Contracting States all pertinent information concerning training establishments assisted through ICAO that admit students from other countries. 5. The Council should urge Contracting States to make the maximum practicable use of training centres in their area for training their aviation personnel in fields where there are no correspond- ing national schools. To this end, the Council should encourage States operating training centres to establish favourable condi- tions for attendance by nationals of other States in the area. APPENDIX I The Headquarters and Regional Offices Technical Secretariat WHEREAS there is a continuing need to provide effective assistance to Contracting States in the implementation of regional plans, SARPS, PANS and SUPPS; WHEREAS it is important that the technical secretariat of the Headquarters and the regional offices is effectively used to provide assistance to Contracting States in their implementation problems; and WHEREAS it is important that, for the proper execution of their tasks, the members of the technical secretariat of the Headquarters and the regional offices are enabled to maintain their technical proficiency and are kept adequately informed of the latest development in their particular fields.
- 50 - А18-13 (Cont’dl APPENDIX I (Cont'd) THE ASSEMBLY RESOLVES that: (1) the resources of the Headquarters and regional offices technical secretariat shall be effectively deployed to provide optimum assis- tance to the Contracting States in their problems relating to the - implementation of regional plans, SARPS, PANS and SUPPS; and (2) the members of the Headquarters and regional offices technical secretariat shall be enabled to maintain their technical pro- ficiency and to keep adequately informed on the latest technical developments. ASSOCIATED PRACTICES 1. The members of the Headquarters and regional offices technical secretariat should be enabled to carry out frequent visits of adequate duration when such visits are necessary or are requested by Contracting States to assist them with their implementation problems. 2. To the maximum practicable extent, temporary assignment of special- ized personnel from one regional office to another and from Head- quarters to the regional offices should take place when temporary reinforcement in the regional offices is required. 3. The members of the Headquarters and regional offices technical secretariat should be enabled to keep adequately up to date in their particular fields by,inter alia, attendance at selected technical meetings, visits to research and development organiz- ations and witnessing trial applications and evaluation of new equipment and techniques. However, such visits should not be allowed to take priority over the primary function of the Secre- tariat to serve the Organization and its several deliberative bodies. Furthermore, the travelling on such visits should be integrated as far as possible with travel necessary to the per- formance of other ICAO duties. APPENDIX J Units of Measurement W HE HE AS in the interest of safety of international air operations unifi- cation of units of measurement should be achieved; and WHEREAS it is important that standard units of measurement are used in ICAO air navigation publications;

(Cont'd) APPENDIX J (Cont'd) THE ASSEMBLY RESOLVES THAT: (1) the unification of units of measurement to he used in international civil aviation shall be achieved on the basis of the International System of Units (SI) except in those cases in which it appears im- practicable or undesirable to do so; (2) meanwhile, in all ICAO air navigation publications the units of measurement shall be expressed primarily in the units of the ICAO Table of Annex 5 where appropriate units exist therein; (3) in addition to (2) above, equivalent units of measurement (or approximate equivalents if more suitable) may be expressed in those publications: i) normally in the units of measurement of the International System of Units (SI) and of the Blue Table of Annex 5 where these differ from the units of the ICAO Table; or ii) in other units of measurement that are in general use in international air navigation; and (U) notwithstanding (3) ii) above, any equivalents of the ICAO Table used in examples of air/ground communications shall be drawn either from the Blue Table or from the’SI units. APPENDIX К Co-ordination of Civil and Military Air Traffic WHEREAS the airspace as well as many facilities and services should be used in common by civil aviation and military aviation; WHEREAS Article 3 (d) of the Convention requires that the Contracting States undertake, when issuing regulations for their state aircraft, that they have due regard for the safety of naviga- tion of civil aircraft; WHEREAS satisfactory solutions to the problem of common use of airspace have not been evolved in all areas; and WHEREAS although full integration of the control of civil and military air traffic may be regarded as the ultimate goal, improvement in co-ordination in many States offers, at the present time, an immediate approach towards resolution of existing diffi- culties ;
- 52 - А18-13 (Cont’d) APPENDIX К (Cont’d) THE ASSEMBLY RESOLVES that: (1) the common use by civil and military aviation of airspace and of certain facilities and services shall be arranged so as to ensure safety, regularity and efficiency of international civil air traffic; (2) the regulations and procedures established by Contracting States to govern the operation of their state aircraft over the high seas shall ensure that these operations do not compromise the safety, regularity and efficiency of international civil air traffic and that, to the extent practicable, these operations comply with the rules of the air in Annex 2. ASSOCIATED PRACTICES 1. Contracting States should as necessary initiate or improve the co-ordination between their civil and military air traffic services to implement the policy in (1) above. 2. The Council should ensure that the matter of civil and military co-ordination in the use of airspace is included, when appropriate, in the agenda of divisional and regional meetings. J. When establishing the regulations and procedures mentioned in resolving clause (2), the State concerned should co-ordinate the matter with all States responsible for the provision of air traffic services over the high seas in the area in question. APPENDIX L Certificates of Airworthiness, Certificates of Competency and Licences of Flight Crews WHEREAS Article 33 of the Convention does not explicitly define the purposes for which recognition is to be accorded to certificates and licences; WHEREAS several interpretations exist as to whether or not there is any obligation on Contracting States to recognize certificates and licences issued or rendered valid by other Contracting States pending the coming into force of SARPS applicable to the air- craft or airmen involved; and WHEREAS with respect to certain categories of aircraft or classes of air= men, it may be many years before SARPS come into force or it may be found most practicable not to adopt SARPS for some categories or classes ;
- 53 - Al8-13 (Cont'd) APPENDIX L (Cont'd) THE ASSEMBLY RESOLVES that: (1) certificates of airworthiness and certificates of competency and licences of the crew of an aircraft issued or rendered valid by the Contracting State in which the aircraft is registered shall be recognized as valid by the other Contracting States for the purpose of flight over'their territories, including landings and take-offs, subject to the provisions of Articles 33 and 32 (b) of the Convention; and (2) pending the coming into force of international standards respect- ing particular categories, classes or types of aircraft or classes of airmen, certificates and licences issued or rendered valid, under national regulations, by the Contracting State in which the aircraft is registered shall be recognized by the other Contracting States for the purpose of flight over their territories, including landings and take-offs. APPENDIX M The Provision of Adequate Aerodromes WHEREAS major improvements to physical characteristics of aerodromes are required at many locations; WHEREAS in certain cases these improvements will involve considerable out- lay and it would be inadvisable to plan such work without taking into account future developments; WHEREAS aerodrome authorities will continue to need to know the general trends in aerodrome requirements which succeeding generations of aircraft will most likely produce; WHEREAS many serious problems can be avoided if the operating requirements of new aircraft are such as to permit them to operate economically without further demands on physical characteristics of aerodromes; and WHEREAS the local social effects of the present-day generation of aircraft have approached the limit of acceptability at some locations; THE ASSEMBLY RESOLVES that: (1) the technical requirements for aerodromes shall continue to be kept under review by the Organization; and
- 51* - Л18-13 (Cont’d) APPENDIX M (Cont'd) (2) there is a need for future generations of aircraft to be designed so that they are capable of being operated efficiently, and with the least possible social disturbance, from aerodromes used for the operation of present-day jet aircraft. ASSOCIATED PRACTICES 1. In the li^it of the results of the continuing review mentioned in (1) above the Council should: a) develop additional guidance material on future developments; b) provide regional air navigation meetings with data on which to base their recommendations for aerodrome requirements; and c) keep Contracting States informed of developments. 2. The Council should continue to draw the attention of aircraft manufacturers and operators to the policy expressed in resolving clause (2). APPENDIX N Ground and Flight Testing of Radionavigation Aids WHEREAS it is essential that the performance of radionavigation aids is checked through regular testing; and WHEREAS the development of greatly improved ground testing facilities would minimize the need for flight testing; THE ASSEMBLY RESOLVES that: (1) pending the possible availability of greatly improved ground testing facilities, radionavigation aids shall be checked through regular flight testing; and (2) to minimize the need for periodic flight testing, improvements should be made to radionavigation ground equipment, including associated ground testing and monitoring facilities, which would provide the same level of assurance of performance as flight testing- ASSOCIATED PRACTICES 1. Pending the possible development of greatly improved ground test- ing facilities, Contracting States should establish their own flight test units, establish joint units with other States or conclude agreements to have flight tests performed on their behalf with States or agencies that have suitable facilities.

The Council should investigate, in consultation with Contracting States that are engaged in the development and manufacture of radionavigation systems, all possible means of improving ground testing facilities so as to minimize the need for periodic flight testing. 4. The Council should circulate to Contracting States information concerning significant developments respecting improvements to radionavigation ground equipment, including associated ground testing and monitoring facilities., to the extent that those developments will serve to minimize the need for flight testing. APPENDIX 0 Adequate Conditions of Employment for Aviation Ground Personnel WHEREAS conditions of employment that do not correspond with the qualifi- cations and responsibilities of aviation ground services personnel constitute a major cause of difficulty in recruiting suitably qualified, personnel and retaining them after completion of their training; and WHEREAS this difficulty is impeding the satisfactory implementation of regional plans, SARPS and PANS; THE ASSEMBLY RESOLVES that: conditions of employment for personnel in the aviation ground services should be commensurate with the qualifications required and the responsibility carried by them. APPENDIX P Delineation of Air Traffic Services Areas Extending over National Boundaries WHEREAS Annex 11 to the Convention makes provision for a Contracting State to delegate to another its responsibility for providing air traffic services over its sovereign territory;
- 56 - Д18-13 (Cont'd) APPENDIX P (Cont'd) WHEREAS a Contracting State delegating to another Contracting State the responsibility for providing air traffic services within airspace over its sovereign territory does so without derogation of its national sovereignty; WHEREAS the responsibility delegated to the providing State is limited to technical and operational considerations pertain- ing to the safety and regularity of aircraft using the air- space concerned; WHEREAS the providing State in implementing air traffic services within airspace over the territory of the delegating State will do so in accordance with the requirements of the delegating State which is expected to establish such facilities and services for the use of the providing State as are jointly agreed to be necessary; and WHEREAS both the delegating and the providing State can reserve the right to terminate any such agreement at any time; THE ASSEMBLY RESOLVES that: the boundaries of the ATS airspaces shall be established on the basis of technical and operational considerations and if, because of the needs of international air traffic,any such airspaces need to extend across national boundaries, agreement thereon should be negotiated between the States concerned. ASSOCIATED PRACTICES 1. The Contracting States should seek solutions to the problem of achieving efficient delineation of ATS airspaces, the optimum location of points for transfer of responsibility and the most efficient co-ordination procedures in co-operation with other States concerned and with the Organization rather than by taking unilateral action. 2. The Contracting States should consider, as necessary, establishing a joint air traffic services authority to be responsible for the provision of air traffic services within ATS airspaces extending over the territories of two or more States.
- 57 - А18-13 (Cont'd) APPENDIX Q Co-ordination of National Research and Development Work in the Fields of Telecommunications, Navigational Aids and Aerodrome Services WHEREAS the Organization plays a useful role in the co-ordination of national research and development works in the fields of telecommunications, navigational aids and aerodrome services; and WHEREAS it is important for States engaged in research and development to have timely information from the Organization on the operational requirements of international civil aviation in those fields; THE ASSEMBLY RESOLVES that': international co-ordination of research and development related to telecommunications, navigational aids and aerodrome services shall be encouraged but without impeding the essential freedom of action in research and development. ASSOCIATED PRACTICES 1. The Council should give due attention to the timely establishment of the operational requirements of international civil aviation in the fields of telecommunications, navigational aids and aero- drome services. 2. The Council should encourage Contracting States to provide the Organization with current information on the progress in research and development projects of significant interest. Selected parts of such information should be circulated by the Organization to Contracting States. APPENDIX R Participation by States in the Technical Work of ICAO WHEREAS technical contributions of Contracting States are essential to attain satisfactory progress in the technical work of the Organ- ization; WHEREAS difficulties are from time to time experienced in obtaining prompt and adequate contributions from Contracting States to the technical work of the Organization; and WHEREAS it is necessary to ensure that maximum benefit is obtained from this participation without imposing an undue burden on the Contracting States and the Organization;

ASSOCIATED PRACTICES 1. The Council should encourage effective participation by Contract- ing States in the technical work of the Organization, paying due regard to the need to minimize the cost to the Organization and the Contracting States of such participation. 2. In so far as each may find it practicable, Contracting States should: a) assist, by correspondence, in advancing ICAO technical projects; b) attend ICAO meetings and participate actively in pre-meeting preparations,particularly by presenting advance documentation containing either specific proposals relative to items of the agenda or their views on documentation submitted to them; c) participate in ICAO panel activities and ensure that their nominees are suitably qualified and are able to contribute effectively to the panel work; d) undertake specialized studies as requested by the Organization; and e) assist the Organization in its technical work through any other means the Council may devise. APPENDIX S ICAO Technical Manuals WHEREAS up-to-date technical guidance material made available through ICAO provides extremely valuable assistance to administrations in the planning for implementation of Standards and Recommended Practices, Procedures for Air Navigation Services and Regional Plans; and WHEREAS it is equally important to provide for the availability of appropriate technical guidance for the training of staff and the updating of the knowledge of operating personnel, as warranted by advancing technology, thus improving the quality of service and enhancing the level of safety in air operations; and
- 59 - Al.8-13 (Cont'd) APPENDIX S (Cont'd) WHEREAS no satisfactory alternative exists for the provision of such guidance material on an international level other than under the aegis of ICAO; THE ASSEMBLY RESOLVES, that: (1) priority be provided for the continuing updating of the contents of present ICAO Manuals and the development of additional guidance Manuals as warranted by advancing technology, thus ensuring optimum value for States in their implementation of Standards and Recom- mended Practices as well as planning and implementation for the provision of facilities and services; and (2) the ICAO Manuals Programme be kept under review by the Council so as to ensure that all appropriate technical fields are adequately covered by the necessary guidance material. A18-1U: ICAO Technical Manuals WHEREAS on a continuing basis valuable technical information for guidance material becomes available to the Secretariat, but the incorpo- ration of such information in existing ICAO Manuals and the devel- opment of new Manuals, as appropriate, is a major task in terms of both technical and administrative personnel requirements, involving conflicting priorities; and WHEREAS improvement in the preparation and publication of such material by ICAO within its Manuals Programme would require special measures related to Secretariat capacity and publication practices; THE -ASSEMBLY RESOLVES that: (1) implementation of the "continuing policy" on ICAO technical Manuals enunciated by the Assembly at its Eighteenth Session be actively pursued; (2) the Council, accordingly, seek means by which’ appropriate technical Manuals can be produced and published without undue delay and without competing with priorities in the production of routine publications.
- бО - Д18-15: Unification of units of measurement WHEREAS a number of States have notified a difference from the ICAO Table of Units in Annex 5 with respect to the provision of altimeter setting information; WHEREAS,as a consequence, pilots of aircraft engaged in international oper- ations may receive altimeter pressure setting values in millibars, millimetres or inches; and WHEREAS this situation may create hazards in terms of terrain clearance or separation of aircraft through the possibility of human error due to extra cockpit workload and from misinterpretation; THE ASSEMBLY RESOLVES: to urge all States which have as yet not done so to establish a pro- gressive programme aimed at the early introduction of millibars as the single unit for altimeter settings and that in the meantime those States be urged to provide, on request, altimeter settings in millibars. A18-16: Problems arising out of the lease, charter and interchange of aircraft in- international operations WHEREAS it is in the general interest of international civil aviation that arrangements for lease, charter and interchange of aircraft, particu- larly aircraft without crew, be facilitated; WHEREAS the international provisions in force contain no absolute impediment to the implementation of such arrangements; WHEREAS,inter alia, Annex 6 to the Convention on International Civil Aviation does not prevent the State.of Registry from delegating to another State the authority to exercise the functions incumbent upon it pursuant to that Annex; WHEREAS such delegation may facilitate the implementation of arrangements for lease, charter and interchange of aircraft, particularly aircraft with- out crew; WHEREAS such delegation may only be made without prejudice to the rights of third States; WHEREДЯ the Convention on International Civil Aviation was developed prior to the widespread application of international lease, charter and inter- change of aircraft, particularly aircraft without crew; WHEREAS the Convention on International Civil Aviation places on a State of Registry responsibilities that it may be unable to fulfil adequately in instances where an aircraft registered in that State is leased, chartered or interchanged, in particular without crew, by an operator of another State;
-- '61 - WHEREAS the Convention on International Civil Aviation, may not adequately specify the rights and obligations of the State of an operator of the aircraft leased, chartered or interchanged-, in particular with- out crew; and WHEREAS the safety and economics of international air transportation may be adversely affected by the lack of clearly defined responsibilities for aircraft leased, chartered and interchanged, in particular with- out crew, under the existing provisions of the Convention on Inter- national Civil Aviation; A Lease.-, Charter and Interchange of Aircraft - Annex 6 to the Convention on.International Civil Aviation THE ASSEMBLY URGES STATES: (1) that,- where arrangements for the lease, charter and interchange of aircraft - particularly aircraft without crew - would be facilitated, the State of Reg- istry of such an aircraft, to the extent considered necessary, delegate to the State of the operator its functions under Annex 6 to the Convention on International Civil Aviation; and (2) that in such cases, the State of the operator change, if necessary, its na- tional regulations to the extent required to empower it both to accept such delegation of functions and to oblige the operator, to fulfil the obligations imposed by Annex 6. В Lease, Charter and Interchange of Aircraft Convention on International Civil Aviation, its Annexes and..other Conventions THE ASSEMBLY DIRECTS THE COUNCIL, in order to take into account the present practices relating to international lease, charter and interchange of aircraftparticu- larly aircraft without crew: (1) to examine the Annexes to the Convention on International Civil Aviation with a view to maxing recommendations for their amendment as soon as practicable; (2) to examine expeditiously the Convention on International Civil Aviation, as well as any other relevant convention, through the appropriate bodies of the Organization or, where deemed necessary, through a connm'tt.ee of experts in the technical, legal and economic fields established for that purpose and submit a report on the subject at the next session of the Assembly at which a Technical Commission is established; and (3) to! obtain and distribute to Contracting States information concerning na- tional laws and regulations pertaining to the lease, charter and inter- change of aircraft, taking into account the financial consequences of this directive.
- 62 - А18-17: International Air Transport Fares and Rates Studies WHEREAS the establishment of international air transport fares and rates that are fair and reasonable and designed to promote the satis- factory development of air services is a matter of major impor- tance to the economies of many States; WHEREAS Governments have a responsibility to the users of air transport for such fares and rates; WHEREAS the objective studies by ICAO of the international air transport fares and rates situation may be of real value to States; WHEREAS it is considered that the cost of such studies can best be deter- mined by a preliminary feasibility study; NOTING that IATA has indicated its willingness to co-operate in such studies; THE ASSEMBLY DIRECTS the Council to initiate a feasibility study to include examination of (i) the principles and relevant economic factors on which inter- national air transport fares and rates are based and (ii) the machinery for establishing such fares and rates; and, provided the outcome of this feasibility study is favourable, to proceed with a first study if necessary resources are available. Al8-18: Tariff Enforcement WHEREAS the aims and objectives of the Organization are to foster the plan- ning and development of international air transport for the purposes set out in Article 44 of the Convention; WHEREAS many governments have entrusted to their international airlines the responsibility of agreeing with other airlines, subject to govern- mental approval, tariffs in respect of the carriage of passengers and freight on international air services; WHEREAS the maintenance of the tariffs so approved is in consonance with the achievement of these aims and objectives; WHEREAS violations of these tariffs are in contravention of many bilateral agreements entered into by governments; WHEREAS concern has been expressed in the course of this Assembly by cer- tain delegations and by the Observer from the International Air Transport Association that the tariffs as agreed and published in accordance with these arrangements are not being fully observed; and
- бз - WHEREAS failure of airlines to observe such tariffs can have serious con- sequences and threaten the economic stability of the international air transport industry; THE ASSEMBLY RESOLVES: (1) that Contracting States and the International Air Transport Association be informed of the concern of the Assembly at the probable consequences of the airlines failing to observe pub- lished tariffs; (2) that the Council invite States: a) to require international air carriers operating scheduled services to file the relevant, tariffs for.approval; b) to require, where this is deemed appropriate by States, air carriers operating international non—scheduled services to file the relevant tariffs for approval; and c) to adopt, where this has not been done, appropriate enforcement or compliance measure, including penalty provisions, to ensure observance of tariffs ^iled and approved ; (3) that the International-Air Transport Association be invited to strengthen and intensify the application of its tariff enforce- ment machinery; (4) that the International Air Transport Association be invited to inform the Organization, whenever it considers it appropriate, of any serious difficulties it encounters in the application of its tariff enforcement machinery; and (5) that the present Resolution supersedes Resolution A16-24. A18-19: Study of possible development of ICAO traffic flow statistics WHEREAS the question of traffic flow statistics requires further consideration by ICAO: THE ASSEMBLY DIRECTS the Council to undertake studies of the possible development of the present programme of traffic flow statistics along the lines indicated in Recommendation No. 14 of the Fifth Session of the Statistics Division.
- 6U - A18-20: Regional. Air Transport Studies WHEREAS the Assembly, in Resolutions A1U-3U and A15-17, directed Council to undertake regional studies on the development of international air freight and air passenger transport respectively, and a number of such studies have already been published; WHEREAS further work pursuant to Resolution A1U-3U will be undertaken only if requested by a number of States in a region, and the series of studies called for by Resolution Л15-17 is nearing completion, so that a decision appears desirable on the future course of the Organization's programme of regional air transport studies; WHEREAS the Assembly continues to recognize the importance of the efficient and economic development of international air passenger arid air freight services in connection especially with the growth of tour- ism and trade and the usefulness of studies designed to further this development; and WHEREAS it is desirable to consolidate past directives into a single reso- lution indicating the continuing policies of the Assembly in this matter, for which purpose the original Resolutions AlU-3^ and A15-17 should be cancelled; THE ASSEMBLY: (1) RESOLVES that the Council undertake, as a continuing programme, regional studies of the development of international air pass- enger and air freight transport, condensing the contents of the -i ndi vi dual studies to the extent feasible, the overall objective of these studies being to assist States by providing current information on trends and developments, indicating obstacles to further development, and measures to overcome these obstacles; (2) DECLARES that the present Resolution supersedes Resolutions A1U-3U and A15-17- A18-21: Air Transport Work in the Regions - General Policy WHEREAS the Assembly, in Resolutions A1U-32, A15-19 and A15-20, gave directions regarding ICAO's general policy with respect to air transport work in the regions; WHEREAS the Assembly, in Resolution A15-2, instructed the Council to study and submit to the next Session a new text classifying and consolidating the resolutions in force, including those of the 15th Session;
- 65 - Al8-21 (Cont’d) WHEREAS these directions need to be consolidated into a single resolution indicating the continuing policies of the Assembly in this matter, for which purpose the original resolutions or parts of resolutions should be cancelled; and WHEREAS Clauses 1, 2, 3 and 5 of the consolidated Resolution A16-23 have been implemented or otherwise require addition, amendment or dele- tion and a new consolidated resolution is needed to replace A16-23; THE ASSEMBLY/: (1) INVITES the Council: a) to give sympathetic consideration to requests for assistance in air transport matters of regional interest presented by Contract- ing States or regional organizations and, when required, to support the creation, on the request of States, of regional civil aviation bodies likely to establish with ICAO relations comparable to those which ICAO maintains with the European.Civil Aviation Conference pursuant to Resolution A10-5; b) in response to these requests for assistance, to make effective use of the services of the Secretariat, including the Regional Offices, particularly for direct contacts; c) to examine the needs of States and to look into the most efficient ways and means of providing effective services in the regions so that States may be served as well as possible in air transport matters; (2) REQUESTS the Council to review from time to time and to amend as necessary the functions of the Regional Air Transport Officers so that they may give effective help to States on questions relating to the economic development of air transport; (3) REQUESTS the Council to evaluate and report back to the Assembly on the effectiveness of all Regional Air Transport Officers and their conformity with the functions approved in accordance with Clause (2) above; (U) EMPHASIZES the desirability of States making use of the assistance the Organization can provide regarding regional co-operation in the air transport field; and (5) DECLARES that the present Resolution supersedes Resolution A16-23.

(minimum'assessment)' WHEREAS the minimum assessment of .13 percent and maximum assessment of . 30 percent were approved by . the Assembly at a time when ICAO had only 75 Contracting States; WHEREAS ICAO now has 120 Contracting States; WHEREAS since the 16th Assembly four States representing- 15-11 percent of the total assessments in 1971 have become members of ICAO; and •WHEREAS the Assembly believes that all Contracting States should'share in the reduction in scales of contributions allowed by addi- tional contributions to the Organization;* Therefore, -THE ASSEMBLY RESOLVES: (1) that all Contracting States share in the assessment reduction permitted by the addition of four new Contracting States;* (2) that Resolution А12-30,- paragraph-(1) (b)-(ii) be amended to read: "the minimum contribution of any one'Contracting State should be .10 percent for a full financial year"; (3) that the foregoing amendment shall enter into force beginning with the year 1972. - 73 - А18-26 (Cont'd) (2) that the approved scales of assessments shall not he adjusted to include the assessments of new Member States joining the Organization in the in- terval between Assemblies; the assessments of these new States shall be kept in addition to the existing 100 per cent scale and their contri- butions shall be credited to the General Fund; , (3) that the draft scales of assessments for the calendar years 1975» 1976 and 1977 shall be prepared by the Secretary General on the basis of the principles set out in Clause 1 of Resolution A12-30, as amended by Reso- lutions A18-21* and A18-25, incorporating the assessment percentages of any new Contracting States that may join the Organization after the Eighteenth Session of the Assembly, in the light of the-principle embodied in Clause 1 of A18-2h; (M that Resolutions A16-53~and A16-5^- are hereby superseded effective 1 January 1972. Al8-27; Supplementary Appropriation Limits THE ASSEMBLY . NOTES: (a) that the financial limits concerning Council authority to approve supplementary appropriations when the Assembly is not in Session contained in Financial Regulation 5-2 a) were last reviewed and revised in 1959 and set at that time at the level of $100 000 for the first year of a bud- get triennium and $150 000 each for the second and third years; (b) that the 1959 gross appropriation level of approximately $h UOO 000 will increase to approximately $11 88h 000 as an average in the triennium 1972-1973-197^; and therefore RESOLVES: that Financial Regulation 5-2 a) contained in Doc 7515/5 be amended as follows, effective 1 January 1972: "ARTICLE V - APPROPRIATIONS 5-2 The Council may, in respect of a given financial year, approve appropriations in excess of the budget voted by the Assembly, which may be met to the extent necessary by advances from the Working Capital Fund as follows: a) up to an amount not exceeding $200 000 in respect of the first year following adoption of the budget, $300 000 in respect of the second year and $150 000 in respect of the third year, to meet unavoidable expenditures other than those specified in Regulation 5.2b) and c);" .
- 7U - A18-28: Working Capital Fund THE ASSEMBLY NOTES that: (1) in accordance with Resolution A16-55 the Council has reported upon and the Assembly has considered the adequacy of the level of the Working Capital Fund and the related borrowing authority; (2) the level of the Working Capital Fund has been adequate and the financial position of the Organization has been sound during the years 1968, 1969 and 1970; (3) it is not considered necessary to assess Contracting States for cash deficits caused by arrears in contributions; (h) the percentage relationship of the Working Capital Fund to the annual appropriation has substantially decreased in recent years and will become even less under the appropriation levels likely to be approved for 1972, 1973 and 197^; (5) the timing of payments of assessed contributions by Contracting States has become less satisfactory during recent years than was the case earlier, and that this could weaken the financial posi- tion of the Organization unless corrected; (6) it has not been necessary for the Organization to use the borrowing authority approved by the Sixteenth Assembly; (7) the Council has recommended an increase in the level of the Working Capital Fund and continuance of the borrowing authority in the next triennium because of the increased expense level anticipated and the uncertain future effect of economic developments on the Organ- ization's expenses; acid therefore RESOLVES: (1) that Resolution A16-55 is no longer effective and is hereby superseded; (2) that the level of the Working Capital Fund be established at $1 100 000 effective 1 January 1972, subject to temporary increases resulting from advances paid by new States becoming members of the Organization after approval of the 1972 scale of assessments; (3) that the increased level of the Working Capital Fund be attained as follows: a) the amount of the assessed advance to the Working Capital Fund of each Member State on 1 January 1972 shall be determined on the basis of the 100$ scale of assessments for the General Fund for 1972;
- 75 - b) new States that joined the Organization during the years 1969 , 1970 and 1971 shall have credited toward such assessed advances under a) above the amount of their respective advances to the Working Capital Fund as assessed upon their becoming members of the Organization; c) other Contracting States shall have credited toward such as- sessed advances under a) above the amounts of their individual equities in the Working Capital Fund as of 31 December 1971 as determined on the basis of the scale of assessments for the General Fund for the year 1969; d) such Contracting States referred to under c) above shall also have credited toward their total assessments, including their assessed advances under a) above, their respective shares in a distribution of $180 000 of net realized surplus of the Organ- ization accumulated in years prior to 1970, such shares to be determined on the basis of the amounts assessed for the years to which the realized surplus relates, starting from the earliest; (1) that after satisfaction of the assessed advances under (3) above by application of the credits described and any necessary balancing payments, the equities of Contracting States in the Working Capital Fund shall be as determined on the basis of the scale of assessments for the General Fund for 1972; (5) that to finance regular and supplementary appropriations that cannot be financed from the General Fund and the Working Capital Fund the Secretary General be authorized, with the prior approval of the Finance Committee of the Council, to borrow amounts needed to meet immediate obligations of the Organization, and that he be required to repay such amounts as rapidly as possible, the outstanding total of such indebtedness of the Organization at no time to exceed $100 000 during the year 1972 and at no time to exceed $500 000 during the remainder of the triennium; (6) that the Council shall report to the next major'session of the Assembly: a) on the adequacy of the level of the Working Capital Fund in the light of experience during 1971, 1972 and 1973; and b) whether the financial position of the General Fund and the Working Capital Fund would indicate the need for assessing Contracting States for cash deficits caused by arrears of contributions; and URGES that States in arrears meet their obligations to the Organization as promptly as possible and that all Contracting States pay their assess- ments as early in the year in which they fall due as their financial systems permit, in order to lessen the need for the Organization to draw on the Working Capital Fund.
- 76 - А18-29: Confirmation of Council action with respect to the assessments of the Hungarian People's Republic, the People's Democratic Republic of Yemen, Mauritius and the Union of Soviet Socialist Republics WHEREAS Financial Regulations 6.8 and Т.Н provide that the Council shall, if the Assembly is not in session, determine the contributions of a new Contracting State, subject to approval or adjustment at the next session of the Assembly; WHEREAS the Council has acted accordingly in respect of the States which became members of the International Civil Aviation Organization after the Sixteenth Session of the Assembly, namely, the Hungarian People's Republic on 30 October 1969, the People's Democratic Republic of Yemen on February 1970, Mauritius on 1 March 1970, and the Union of Soviet Socialist Republics on 1U November 1970; THE ASSEMBLY CONFIRMS the action of the Council in assessing the contri- butions of the Hungarian People's Republic at the rate of . U8% of the total scale of 100%, of the People's Democratic Republic of Yemen and Mauritius at the minimum rate of .13%, and of the Union of Soviet Socialist Republics at the rate of lU.37%, such assessment rates to apply for each respective Contracting State from the first day of the month following that in which it became a member of the Organization through 31 December 1971- A18-30: Approval of the Accounts of the Organization for the Financial Years 1968, 1969 and 1970 and examination of the Audit Reports thereon WHEREAS the accounts of the Organization for the financial years 1968, 1969 and 1970 and'the Audit Reports thereon, submitted by the Auditor General of Canada - a member of the Joint Panel of Auditors of the United Nations and Specialized Agencies - as the External Auditor of ICAO, have been submitted to the Assembly after being circu- lated to Contracting States; WHEREAS the Council has examined the Audit Reports and submitted them with- out comment to the Assembly for its review; and WHEREAS in accordance with Chapter VII, Article h-9 (f) of the Convention expenditures have been reviewed; THE ASSEMBLY: (1) APPROVES the accounts for the financial year 1968 and notes the Report of the External Auditor thereon; (2) APPROVES the accounts for the financial year 1969 and notes the Report of the External Auditor thereon;
